International War Crimes Tribunal Act
An International Criminal Tribunal is hereby established for the administration of justice over war crimes. It shall be a permanent institution and shall have the power to exercise its jurisdiction over persons for the most serious crimes of international concern, as referred to in the Baversonburg Convention, and shall be complementary to national criminal jurisdictions. The jurisdiction and functioning of the Tribunal shall be governed by the provisions of this Statute. The Tribunal shall be brought into relationship with the Declansburg Assembly through an agreement to be approved by the Assembly. This Tribunal is adherent to existing law on tribunals as set out by the Courts and Judiciary act.
The seat of this Tribunal shall be the island of Declansburg in the great sea. The Tribunal may sit elsewhere, whenever it considers it desirable, as directed by the Assembly.
The jurisdiction of the Tribunal shall be limited to the most serious crimes of concern to the international community as a whole. The Tribunal has jurisdiction in accordance with crimes listed in the Baversonburg Convention.
The Tribunal may initiate an investigation at the insistence of any individual party or on itself upon reasonable basis to believe that a crime within the jurisdiction of the Tribunal has been or is being committed, of which it itself will determine. The Tribunal must initiate an investigation at the insistence of the Assembly.
All persons are presumed innocent until proven guilty beyond reasonable doubt, the right to be fully informed of the charges against them, the right to have legal representation, the right to a speedy trial and the right to examine the witnesses against them.
The Tribunal will only prosecute an individual if states are unwilling or unable to prosecute. Therefore, if legitimate national investigations or proceedings into crimes have taken place or are ongoing, the Tribunal will not initiate proceedings. Such determination is at the Tribunals discretion.
